1. Event Ownership & Organiser Identification

The Botswana Diamond Run ("the Event") is organised and operated by Botswana Diamond Run (Pty) Ltd ("the Organiser"), a company registered in the Republic of Botswana. The Organiser's registered office is located at Plot 54, Fairgrounds Office Park, Gaborone, Botswana.

2. Eligibility & Entry

Participation is open to individuals aged 21 years and above at the time of the Event. All participants must hold a valid passport with at least 12 months remaining validity, provide a certified medical fitness clearance, pass a background verification check, and obtain adequate travel and health insurance. The Organiser reserves the right to refuse entry to any applicant at its sole discretion without being required to provide reasons.

3. Prize Terms

Prizes consist of certified diamonds sourced from Botswana. Each diamond is independently graded and certified by the Gemological Institute of America (GIA) and complies with the Kimberley Process Certification Scheme. Prize valuation is determined by independent assessment and is final. Winners are responsible for all customs duties, import taxes, and other levies applicable in their country of residence. Transfer of prize diamonds is subject to compliance with all applicable export and import regulations.

4. Assumption of Risk & Waivers

The Event involves physical activities in wilderness environments that carry inherent risks, including but not limited to injury, illness, animal encounters, extreme weather, and remote location challenges. By participating, each participant acknowledges and voluntarily assumes all risks associated with the Event. Participants are required to sign a separate Participant Waiver and Release form prior to commencement of the Event.

5. Media Rights & Releases

The Organiser and its authorised media partners retain the right to photograph, film, and record participants throughout the Event. By participating, each participant grants the Organiser an irrevocable, royalty-free, worldwide licence to use their name, likeness, image, and voice in promotional materials, broadcasts, documentary content, and social media.

6. Insurance Requirements

All participants must hold valid international travel insurance and comprehensive health insurance covering emergency medical evacuation for the duration of the Event. The Organiser maintains supplementary event-specific insurance coverage but this does not replace participant obligations to hold their own policies.

7. Cancellation & Force Majeure

The Organiser reserves the right to modify, postpone, or cancel the Event due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, government orders, civil unrest, or significant safety concerns. In the event of cancellation by the Organiser, a full or partial refund will be issued in accordance with the published Refund Policy.

8. Data Protection & Privacy

The Organiser collects and processes personal data in accordance with its Privacy Policy and applicable data protection laws of Botswana. Participants have the right to access, rectify, and request deletion of their personal data, subject to legal and regulatory requirements. Full details are set out in the Privacy Policy.

9. Dispute Resolution & Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Botswana. Any dispute arising from or in connection with these Terms shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Gaborone, Botswana.
