Statement of Risks
The Botswana Diamond Run involves multi-stage physical activities conducted in wilderness environments across Botswana. These activities include, but are not limited to: hiking, running, and endurance exercises in remote terrain; watercraft navigation (mokoro and other vessels); exposure to extreme heat, cold, rain, and other weather conditions; proximity to wildlife including large mammals and reptiles; off-road vehicle travel over unpaved surfaces; camping in remote wilderness areas; and night-time activities in low-visibility conditions. These activities carry inherent risks of injury, illness, property damage, and in extreme circumstances, loss of life.
Participant Confirmations
By signing this waiver, I confirm that: I am in good physical and mental health and have obtained a medical fitness clearance from a licensed physician; I have disclosed all known medical conditions, allergies, and medications to the Organiser; I am physically capable of participating in strenuous outdoor activities; I hold valid travel and health insurance covering emergency medical evacuation; I have read and understood the Terms and Conditions and Privacy Policy of the Event; and I am participating voluntarily and of my own free will.
Assumption of Risk
I acknowledge that I understand the nature of the activities involved in the Event and the associated risks. I voluntarily assume all risks of participation, including risks of injury, illness, property damage, or death, whether caused by the condition of facilities, the actions of other participants, or any other cause. I understand that while the Organiser takes reasonable measures to ensure participant safety, no activity in a wilderness environment can be made entirely risk-free.
Indemnity Clause
I hereby agree to indemnify, defend, and hold harmless the Organiser, its directors, officers, employees, agents, contractors, partners, and affiliated organisations ("the Indemnified Parties") from and against any and all claims, damages, losses, expenses, and costs (including legal fees) arising from or related to my participation in the Event, except to the extent caused by the gross negligence or wilful misconduct of the Indemnified Parties.
Limitation of Liability
The Organiser's liability to any participant shall be limited to the entry fee paid by that participant, except in cases of death or personal injury caused by the Organiser's gross negligence or wilful misconduct. The Organiser shall not be liable for any indirect, consequential, or incidental damages.
Digital Signature & Execution
This waiver may be executed electronically. A digital signature, together with the associated timestamp and IP address, shall constitute a valid and binding execution of this waiver, with the same legal effect as a handwritten signature.
